Non-Payment of Wages, Pensions, Scholarships, Allowances and Other Payments: the Subject of the Crime under the Criminal Code of the Russian Federation

The article analyzes the concept of the subject of a crime in Art. 145.1 of the Criminal Code of the Russian Federation, which establishes liability for non-payment of wages, pensions, scholarships, benefits and other payments. The article provides a list of payments for which non-payment is subject to liability under this norm. The existence of an independent subject of a crime in Art. 145.1 of the Criminal Code of the Russian Federation is substantiated. Court practice on the prevalence of non-payment of certain types of payments is presented. The article concludes that it is more appropriate to criminalize the non-payment of wages and other types of payments made by the employer.
